Working Out of Hours Permit

Darebin City Council recognises the need to manage construction works to minimise any adverse impact to the community. These controls are contained within the General Local Law 1 of 2015 which permits building works within the following hours:

  • 7am and 8pm – Mondays to Fridays
  • 9am and 6pm – Saturdays
  • Building activity is allowed on public holidays and will need to meet the same times listed above, depending on the day the public holiday falls on.

Paid construction work is not permitted on Sundays. Owners and occupiers are permitted to undertake works on a Sunday between 9am-6pm in premises that they are living in.

It is expected that building sites complete their works within the above prescribed hours, unless in the case of an emergency or for the specific reasons listed below.

Out of hours application

Construction sites that request to complete works beyond the times above require an ‘out of hours’ permit.

Applications for out of hours permits are subject to approval and may be refused as they are a major source of complaints. Running behind schedule on your building project is not a suitable reason to apply for an out of hours permit.

Out of hours permits may be granted for the following types of work:

  • The nature of the work makes it more desirable to be completed on the weekend such as crane installations or removal
  • Over-sized vehicle loads that cannot be transported during normal hours
  • Works that cannot be completed within normal hours such as concrete pours
  • It can be demonstrated that the nature of the work will not have any adverse impact on local amenity with the sound, noise and vibration mitigation measures to be implemented.

The responsibility lies with the principal contractor to demonstrate why a request for out an of hours permit should be granted. The contractor is also responsible for ensuring that all personnel on site (employee and sub-contractors) are aware of the requirements of the Darebin Local Law.

Noise and vibration considerations

It is unlikely that a request for an out of hours permit will be approved for work of a noisy nature, like the following activities:

  • Excavation
  • Demolition
  • Concrete cutting/jackhammering

These should be completed within Local Law hours.

Supporting Documents

To assist in your application being processed in a timely manner please include the following documents (if they apply):

  • Application for out of hours permit - please complete PDF and send with required documents to asset@darebin.vic.gov.au 
  • VicRoads Memorandum of Authorisation (MoA) for heavy vehicle use
  • Access permit from the National Heavy Vehicle Register (NHVR)
  • Permits from Yarra Trams, Public Transport Victoria (PTV), VicTrack or VicRoads (now known as DTP)
  • Notification letter to residents and businesses within 100m of the site (to be issued 14 days prior to works commencing)
  • Traffic Management Plan demonstrating the area of occupation and how the public will be managed during occupation
  • Proof of Public Liability Insurance - $20,000,000 minimum

Council will make all endeavours to process an application within 15 working days. Please note that missing information or supporting documents will likely result in delays.

Roads, footpaths and hoarding

Out of hours requests may also include the need for temporary partial or full closure of road, footpath or laneway, or a hoarding area.

Contact Council to arrange an occupation permit for the times and dates required. You can apply online, please allow plenty of time to prepare supporting documents and receive approvals prior to the date that works are expected to take place. Find out more on our Traffic management plans page.

Some arterial roads may need approval by DTP, which will need to be obtained independently of Council. 

Complaint handling

Stakeholders should have been notified in writing before the commencement of your out of hours works.

Stakeholders can include those affected by changes to access, traffic, parking, noise related activities, changes to footpath access.

It is expected that you will have a process in place to deal with complaints about your construction works.
